I think you will find that they are within the law as it currently stands as they are not trading as a Private Hire or Taxi organisation but a private members organisation.

Any way I have asked the relevant authorities for an update on the situation.

Obviously so Gary but 'how' seems to be the number one question on some people's minds  A simple answer and explanation 'why' would have ended all the speculation a long time ago.

Interesting back in January the Council Licensing Dept were actually advising people that PL's were indeed trading outside of the new licensing laws and meetings were in hand to resolve the 'problem', guess this added to the confusion  Anyway after all the meetings and letters they have obviously sorted it out now and PL's are still exempt.

Good news for all the childminders and other bods who have hopefully also become exempt from the new rules in the same process :D

Quite simple - they have a private members club!

The council are unable to comment because it is still with their legal department!

Search me. Some people seem to be getting very incensed about it and want to spread their displeasure around.:wink:

Maybe the thought ?Any publicity is good publicity? is being applied to this instance but overall, I think a topic like this is probably more damaging to this company than anything.

Had the company simply set its goals on providing a specialist lady only taxi service within the current laws, then I believe they could have been more successful by remaining focused on their objectives. As I see it now, the company?s future hangs in the balance and much depends on whether or not WBC can afford the legal expense of pursuing this matter.

I always thought that any licensed Taxi cannot refuse a fare? thus making an Exclusive service for Females impossible as that would break the laws of a licensed Taxi? or are the rules different in the UK..??

All companies be they private hire or hackney can legally refuse to take a fare provided they have good grounds for refusing. If they were to refuse anyone based solely on their race, colour, sex, disability etc they could indeed have their licence to operate withdrawn. In the case of Pink Ladies though, there isn?t the option to revoke a licence because as far as I know the cars aren?t actually licensed.

That said, the sex issue doesn?t appear to be the main bone of contention and it?s more the case that the company seems to be cocking a snoop at the council by refusing to accept any of the rules that govern the rest of the taxi trade.

They are, by any stretch of the imagination, just a small private hire company that believe that they should be exempt from the rules due to their uniqueness. But in my considerable experience of taxi companies across the UK, I see absolutely nothing unique, other than the refusal to comply with the law.

I don?t think the objections from the trade relate to the ladies only issue but more the fact that that their drivers and cars are not being subjected to the same legal testing requirements and are so are avoiding all the associated fees that other companies have to pay.

I understand that but if they were to do that wouldnt they then be a Taxi firm and not be able to refuse a fare because the person was a male? so i guess they are in a catch 22

Saying that i have not seen any of there Vehicles so i have no idea what state they are in and if they are in roadworthy state and upto the standards of other Taxis? but i am sure this has proberly been stated on the other thread..

No that isn't necessarily true because the company could still continue to operate wholly on account trade just as they do now.

I have several clients that work this pretty much this way and do very good business without the hassle of cash or plonkers.

Companies that operate this way don't tend to promote their telephone numbers or have walk in offices for the public.

Instead, they have an account manager that allocates either a credit account or a prepaid top up card system.

Either way, there's no legal obligation on them to issue an account so they effectively get to pick their own customers just as Pink Ladies do now.

Perhaps I didn?t make myself quite clear. All companies companies in the UK (except Pink Ladies) whether they operate conventionally or accounts only, are still legally plated and comply with all taxi rules and regs so nobody can object.

I?m sure if they were to come into line, their business would actually benefit. Unless the company is running on empty, the additional costs involved would be worth it if only to restore public confidence and remove bad publicity

TD,

this has been going on for years now and even after all the "they will be off the road after January 31st" stuff last year.

Fact is they are still trading because of a loophole which allows them to do so and that the council seem reluctant either due to potential cost or because they think they won't win, to challenge them.

There are seemingly more of these cars on the road than ever at the moment so nothing is being done to discourage them.

As I have said all along, I disagree with the whole concept of women only stuff as the women were the first ones to kick up a stink when they couldn't get into the mens golf clubs etc. However I would still prefer to be driven in a pink 54 plate Kangoo van with seats in the back than a K reg Sierra and a rusty old Astra belching smoke.....which are a fine example of warrington taxis??
