observer Posted November 5, 2012 Report Share Posted November 5, 2012 There you go again, trying to examine detail, when the whole treaty should be scrapped imo - we've got our own supreme court and elected Gov, so no need for Euro judges overiding them. As for prisoners: if someone is convicted of a crime and sent to prison, it would seem logical that their "rights" would cease for the period of their detention, while they reflect on their responsibilites. observer Posted November 6, 2012 Report Share Posted November 6, 2012 I'll try just once more: "the Act" and what's in it is irrelevent; it's the interpretations applied by Euro Judges which overide the decisions of our supreme court and the sovereignty of OUR Parliament. Like the EU, the ECHR usurps the authority of the Nation State. We may complain about decisions made by out of touch judges in our own courts, but laws that are being misinterpreted by them can be ammended by Parliament. Like the EU, we tend to comply with the letter of it's rules and judgements, whilst in the case of the ECHR others (like Russia) don't. The ECHR originated against a background of the WW2 experiences of the holocaust and abuses by States upon their own people; unfortunatley it has morphed into a vehicle for abuse by HR lawyers to include the trivial and bizare, like prisoners claiming "the right" to vote; like an assylum seeker who killed a young girl with his car, then following prison, seeks to avoid deportation by claiming he's fathered a sprog with a British National and was thus entitled to "a family life".
